As the Rocky Mountain News reports:
A former Democratic Party activist who left dog feces on the doorstep of U.S. Rep. Marilyn Musgrave’s Greeley office during last year’s 4th Congressional District campaign was found not guilty Wednesday of criminal use of a noxious substance.
A Weld County jury deliberated about two hours before acquitting Kathleen Ensz of the misdemeanor count. Her trial began Tuesday.
Ensz’s lawyers never denied that their client left a Musgrave campaign brochure full of feces at the front door of the congresswoman’s office. But they argued that Ensz was making a statement protected by free speech – the poop was a symbol of what she thought of Musgrave’s politics.
“Her only intention of going over there was to make a political statement that Marilyn Musgrave’s politics stink,” attorney Shannon D. Lyons said after the verdict…

Seriously – this is ridiculous. I dislike MM as much as anyone else but this is over the line.
I am no fan of Musgrave–but being allowed to leave dog sht on her door is ok because of her job? Aren’t politicians still people? What’s next? Her beliefs may be a little wacko, but her district elected her—I don’t see home attacking her property can then be seen as free speech. What is she had a small child who was the first to encounter that? Is it ok then because her mother is a politician and we can do/say whatever we want to them?
It was her campaign office-not her home-and if a kid has never seen dog poop-well. Take it for what it was-free speech and a good laugh. And yes-Musgrave Is a Public figure and is subject to a little more than normal people-that comes with the territory.
It was a bad decision. Leaving sh*t at her campaign office isn’t speech. Saying she’s full of sh*t is (it is also correct, but that isn’t my point here).
So Marylin is allowed to leave crap at someone’s home, but they shouldn’t be allowed to leave it at her campaign office? What if someone’s kid was the first to find the Musgrave campaign mailer?

Sorry, I couldn’t help myself. If the worst thing that happens during a campaign involves dog poop on a door step, consider yourself lucky. This trial was a waste of taxpayer dollars.
If we say these “little things” are ok, then what comes next. Some always push the envelope.

This was a silly case that from the get go Musgrave’s people tried to use politically. DA Ken Buck kept it political. The jury probably “smelled” payback, and responded accordingly.

Thanks for the info Harold. It shows the danger of mixing politics and law. Stupid pet tricks and political shenanigans should stay outside of the legal system where we depend on unbiased and rational thought (the opposite of politics?).
These events tend to self regulate. Seems that MM got a bit of sympathy momentum during the campaign from those that thought this was over the line. Who was it that had their campaign HQ vandalized? R O’donnell? He got some sympathy. Obviously not enough.
The Duke lacrosse fiasco is a good example of the destruction that results from politics entering the courts.
Look for a lot more juvenile pranks like this from both sides, as the campaigns heat up next year.
Having spent a good deal of time around Stan Matsunaka’s Greeley HQ (both campaigns)I can tell you that Musgrave’s supporters subjected it to much worse. Including, but not limited to, vandalism. Most of it harmless save the slashed tires. To my knowlege the authorities were never involved. We just considered the scource, cleaned the mess and went about the task of trying to win.
